The show "Real Housewives of Atlanta" has appealed to many Minnesotans but the title could be changed to "Real Ex-wives of Atlanta" after star Porsha Stewart and husband Kordell Stewart decided to end their marriage. After nearly two years of marriage, Porsha is demanding alimony payments from her former NFL star husband. Allegedly the quarterback was not the only one that was "blindsided."
Porsha claimed she found out that her husband was filing for divorce after viewing a tabloid. In response, the angered 31-year-old decided to file her own papers demanding spousal maintenance and the use of the mansion the couple shared.
In addition, Porsha claims she gave up her career in order to raise her husband's son from a previous relationship. The NFL star declared the she does not need alimony or spousal maintenance from him because she is an able body person capable of supporting herself.
In most alimony cases, the spouse that earned less income during the marriage is typically the one who would be awarded alimony. But, there are numerous factors to determine whether alimony is appropriate. When a court determines if a spouse is eligible for alimony, they will look at a number of factors including the couple's standard of living during the marriage as well as the length of time it would take the recipient to get back on their feet financially.
In the Stewarts' case, it will be tricky to figure out what the outcome will be due to the complexity of the situation. Porsha may be able bodied to work but was use to a high-income lifestyle during the marriage.
Many Minnesotans know that every divorce is different, when it comes to determining if spousal maintenance is necessary, an attorney may be the best person to go to for answers.
