When Modifications are Necessary -- Avoiding Problems

It's not uncommon for a change in circumstances to require a modification in a divorce settlement. The loss of a job, illness, or the need to re-locate can effect child custody, child / spousal maintenance, and visitation rights. In order to avoid potentially serious legal problems, it's important to enter a motion before the court to officially modify any change in a family law settlement.

While informal agreements between couples may seem less onerous, they expose both to certain risks. For instance, you may be out of work and a few months behind on child support payments. Even though you may have a good relationship with your ex-spouse now, if the relationship begins to deteriorate he or she can enter an enforcement motion against you, creating a number of legal problems for you. In order to protect our clients, we enter modification motions as soon as a change in circumstances requires them.
