Divorce

Child Custody

Child custody is one of the most misunderstood issues in divorce. Custodial labels are a source of confusion, anxiety and conflict. Accordingly, clients need to understand their significance in order to determine whether these issues are worth contesting, or whether the parties even have a conflict to begin with.

Parenting Time

By focusing on the schedule of when you will be with your child, you can leave out the emotional baggage associated with labels such as visitation, sole custody and joint custody before during or after your divorce.

Child Support

Minnesota's child support guidelines changed to an income-share arrangement in January of 2007.

Alimony

Advising clients about alimony (spousal maintenance) is a challenge. Good attorneys can respectfully agree to disagree as to how much or for how long one party should pay the other in a divorce − or even whether it is an alimony case to begin with.

Property Division

In Minnesota, the law says that you are entitled to a fair and equitable division of marital assets and debts. However, fair and equitable doesn't necessarily mean "equal."

Domestic Abuse

Protective orders give you the power to have the other party removed from the home and award you temporary custody of children.  Given the propensity for these orders to be abused, judges can be skeptical about the legitimacy of spousal abuse allegations made on the cusp of a divorce.

Prenuptial Agreements

Prenuptial agreements are often used in second marriages or in marriages wherein the parties have accumulated significant premarital assets.

Paternity

To obtain custody or visitation rights, an unmarried father must first go to court and file a paternity action. Unmarried mothers can file these actions to obtain child support.
